Orphan Relative Visa (Subclass 837)

The Orphan Relative Visa (Subclass 837) enables single children who are already in Australia to stay with a relative if their parents are deceased, incapable of caring for them, or cannot be located. This visa offers the child an opportunity to migrate to Australia permanently, pursue studies, and access Medicare. Additionally, if eligible, they can apply for Australian citizenship.

Eligibility Requirements for Subclass 837 Visa

In order to be eligible for the Orphan Relative Visa (Subclass 837), the child must meet the following requirements:

  • The child must be under 18 years of age, single, and without a parent capable of caring for them.
  • A relative who is a settled Australian citizen, eligible New Zealand citizen, or Australian permanent resident must sponsor the child.
  • The child must be in Australia but not in immigration clearance at the time of application and when the Australian Department of Home Affairs makes a decision.
  • An eligible sibling or step-sibling, grandparent or step-grandparent, aunt, uncle, step-aunt, or step-uncle must sponsor the child.
  • The child’s parents must be deceased, permanently incapable of caring for the child, or cannot be found. The Department of Home Affairs will not grant this visa if the child’s parents are capable of caring for them but do not want to.
  • The child must have consent to migrate to Australia, which can be obtained through written consent from individuals legally authorized to decide the child’s place of residence, permission granted by the child’s home country, or in accordance with any Australian child order pertaining to the child.
  • The child must hold a substantive visa or have applied for an Orphan Relative Visa within 12 months of the previous substantive visa ceasing. The previous substantive visa cannot be a Subclass 771 Transit visa.
  • The child must meet the health and character requirements.
  • The child must have paid any outstanding debts owed to the Australian government.
  • The child must not have had a visa cancelled or a previous visa application refused.
