TRAINEE (H-3) VISA

Foreigners can come to the United States on a temporary basis to obtain instruction and training, with the exception of graduate medical education. The area of training must not be available in the foreigner’s home country. The training must be useful to them in their career or profession. During the training, the applicant may only engage in productive work in the United States if the work is incidental and necessary to the training program. The applicant’s qualifications and skills must be relevant to the desired training.

TRAINEE VISA (H-3) BASIC REQUIREMENTS

The purpose of the training program must be to benefit the applicant in pursuing a career outside the United States. In addition, the training should be unavailable in the applicant’s home country, and the applicant must not work in the United States, unless such work is incidental and necessary to the training. Eligible applicants cannot be placed in a position in which American workers may be employed.

TRAINEE VISA (H-3) ENTITLEMENTS

The Trainee Visa provides the applicant with the opportunity to train and live in the United States for a period no longer than 2 years, or for special education trainees, for a period no longer than 18 months. Spouses and unmarried children under the age of 21 who wish to accompany or join the principal visa holder in the United States for the duration of his/her stay may apply for the relevant visa.
