Persons under this visa category may enter the United States to perform temporary non-agricultural work, either as a one time, peak load, intermittent or seasonal worker, if there is a demonstrated shortage of US workers for the position. There is a 66,000 per year limit on the number of foreign workers who may receive initial H-2B visas each year from October 1 through September 30. Returning workers are not included in this quota.

SEASONAL NON-AGRICULTURAL WORKER VISA (H-2B) BASIC REQUIREMENTS

The Seasonal Non-Agricultural Worker Visa requires applicants to obtain a visa prior to entry to the United States on the basis that the purpose of their stay is for US employment, which is either a one-time occurrence, peak load, intermittent or seasonal need. The job opportunity must be full-time and require at least 40 hours of employment per week. Applicants may also be required to meet certain health and character requirements.

SEASONAL NON-AGRICULTURAL WORKER VISA (H-2B) ENTITLEMENTS

Seasonal Non-agricultural Worker Visas are granted for an initial period of up to a 1-year stay in the United States; however, the visa may be extended in 1-year increments for a total of a 3 year stay in the US. Spouses and unmarried children under the age of 21 who wish to accompany or join the visa holder in the United States may obtain the relevant visa. This will allow spouses and children to study in private or public schools in the United States without the need to obtain a Study Visa.
