EXTRAORDINARY ABILITY VISA (O-1) BASIC REQUIREMENTS
A US employer or sponsor must submit an application on behalf of the applicant to demonstrate that the applicant’s participation at an event, lecture series or project is required and that the applicant possesses the required extraordinary ability or achievement. Once the application is approved, applicants must then apply for a visa. Applicants may be required to meet certain health and character requirements.
EXTRAORDINARY ABILITY VISA (O-1) ENTITLEMENTS
The applicant is entitled to stay in the United States for up to 3 years with extensions of stay in 1-year increments. Applicants under this category can also have dual intent, meaning the applicant can maintain O-1 visa status while applying for a US Green Card to remain in the US permanently.
Persons accompanying and assisting an applicant who is an artist or athlete may obtain an O-2 visa to enter the US. Spouses and unmarried children under the age of 21 who wish to accompany or join the visa holder in the United States may obtain the relevant visa. This will allow spouses and children to study in private or public schools in the United States without the need to obtain a Study Visa.
