Persons are eligible for the Culturally Unique Artist/Entertainer Visa if they seek to enter the United States to develop, interpret, represent, coach or teach a unique or traditional ethnic, cultural, musical, theatrical or artistic performance or presentation. It may either be a commercial or non-commercial cultural event that seeks to promote the development of the art form.

CULTURALLY UNIQUE ARTIST/ENTERTAINER VISA (P-3) BASIC REQUIREMENTS

The Culturally Unique Artist/Entertainer Visa requires prospective US sponsors or employers to file an application on behalf of the applicant to enter the United States. To qualify, applicants must be seeking to enter the United States in order to develop, interpret, represent, teach or coach in a culturally unique commercial or non-commercial program. Applicants may also be required to meet certain health and character requirements.


CULTURALLY UNIQUE ARTIST/ENTERTAINER VISA (P-3) ENTITLEMENTS

The applicant may remain in the United States for the time necessary to complete the event up to one year and extensions for a similar period. Although applicants must have a foreign residence that they do not intend to abandon., applicants under this categoryHowever, these applicants can also have dual intent, meaning the applicant can maintain P-3 visa status while applying for a US Green Card to remain in the US permanently.

Spouses and unmarried children under the age of 21 who wish to accompany or join the principal visa holder in the United States for the duration of his or her stay require derivative visa status. Spouses and children of visa holders may study in private or public schools in the United States without obtaining a Study Visa. Spouses and children may apply for work authorization if seeking employment for their duration of stay in the United States.
