WORK VISAS TO THE UNITED STATES

RETURNING SEASONAL NON-AGRICULTURAL WORKER VISA TO THE UNITED STATES

Applicants previously holding a Seasonal Non-Agricultural Worker Visa (H-2B) are eligible to receive an H-2R Visa to return to the United States to perform additional seasonal non-agricultural services. Candidates may enter the United States to perform temporary non-agricultural work, which may be one-time, seasonal, or intermittent, for positions for which there is a shortage of U.S. workers.


RETURNING SEASONAL NON-AGRICULTURAL WORKER VISA (H-2R) BASIC REQUIREMENTS

Basic Requirements for this visa include having previously obtained an H-2B Visa. Applicants must obtain an H-2R Visa prior to their entry and show that the purpose of stay is for US employment which is due to a shortage which could not have been filled by existing US workers. The job opportunity must be full-time and require at least 40 hours of employment per week. Applicants will also be required to meet certain health and character requirements.


RETURNING SEASONAL NON-AGRICULTURAL WORKER VISA (H-2R) ENTITLEMENTS

Returning Seasonal Non-Agricultural Visas are granted for an initial period of up to a 1-year stay in the United States, and the visa may be extended for a total of 3 years.

Spouses and children under the age of 21 who wish to visit, accompany or join the visa holder in the United States, may obtain the relevant visa. This will allow spouses and children to study in private or public schools in the United States without the need to obtain a Study Visa.
