FAMILY VISAS TO THE UNITED STATES
FIANCÉE OF US CITIZEN VISA TO THE UNITED STATES
The Fiancée Visa enables US citizens to sponsor their fiancé(e)s living abroad to come to the United States to get married and live and work in the United States on a permanent basis. The Fiancée Visa can only be applied for when the foreign fiancé(e) is outside the United States.
Upon approval of the K-1 Visa, the foreign fiancé(e) may enter the US to get married and apply for permanent residence. As a permanent resident, foreigners have the right to live and work in the United States permanently, leave and return to the United States under certain conditions, attend public schools and colleges and apply to become a US citizen when eligible to do so.
FIANCÉE OF US CITIZEN VISA (K-1) BASIC REQUIREMENTS
The foreign fiancé(e) must be engaged or contracted to be married to a US citizen. The US citizen and foreign fiancé(e) must prove that they have met in person within the last two years unless they belong to a culture in which they may not meet until their wedding day or it would cause extreme financial hardship for the parties to meet in person. Within 90 days of entry into the US, the parties must marry. Applicants must meet certain health and character requirements.
FIANCÉE OF US CITIZEN VISA (K-1) ENTITLEMENTS
The Fiancée Visa provides applicants with the opportunity to reunite with US fiancé(e)s, get married and become permanent residents of the US. In addition, the unmarried children under the age of 21 of the foreign fiancé (e) may accompany their parent to the US by obtaining the relevant visa. While awaiting approval of permanent residence status, the foreign fiancée may apply for work authorization.
