EMPLOYMENT CREATION VISA TO UNITED STATES

Foreign nationals who make a substantial investment in a new commercial venture can come to the United States to live and work in conditional resident status, which can lead to permanent residence. The amount of capital, in some instances, can be as low as $500,000, but, usually, must be at least $1,000,000.

The investment must be in a new commercial business that employs at least ten US workers or authorized immigrant workers in full-time employment. The applicant must be engaged in the business full-time and must be involved in the actual day-to-day management of the business. It is not necessary for the applicant to create a new business as long as he makes the required substantial investment in a new commercial enterprise.

US EMPLOYMENT CREATION VISA (EB-5) BASIC REQUIREMENTS

The Employment Creation Visa mandates that an applicant must usually invest a minimum of $1,000,000 in a new and profitable business venture operation. The new commercial enterprise must employ at least 10 ten US citizens or Green Card holders on a full-time basis. In addition, the applicant must engage in the day-to-day operations of the business. Also, the applicant will be subject to health and character requirements.

US EMPLOYMENT CREATION VISA (EB-5) ENTITLEMENTS

The Employment Creation Visa holders are provided with a 2-year conditional residence to live and work in the United States. This can lead to permanent residence. Their spouse and unmarried children under the age of 21 who wish to accompany the visa holder may also obtain US Green Cards.

Obtaining permanent residence in the US allows residents to take advantage of exceptional benefits. They may travel to and from the United States with few limitations, study and work in the US without any limitations, sponsor their close family members and apply for US citizenship when eligible to do so.
