Tier 2 and Tier 5 UK Visas open on 27 November 2008

Migrant applications for Tier 2 and Tier 5 of the new points based system will open on 27 November 2008, replacing many existing work-based schemes.

Tier 2 replaces the current UK work permit scheme, which allows employers to hire skilled workers from outside the European Economic Area (EEA) and Switzerland to fill a vacancy that might otherwise be filled by a resident worker. Under the new system, employers must obtain a license to sponsor non-EEA/Swiss nationals. Workers applying under Tier 2 are required to have a certificate of sponsorship issued by the employer. Further they need to score a pass mark of 70 points from the three sets of criteria. These are:

  • attributes (sponsorship, qualifications, and prospective earnings);
  • English language skills; and
  • maintenance

Tier 5 covers temporary workers coming to the UK for a short period, such as working holidaymakers, charity workers, religious workers, and sports and entertainment teams. Employers and other organisations are required to have a sponsorship license in order to employ people coming to the UK under Tier 5. Workers applying under Tier 5 need to have a certificate of sponsorship and score a pass mark of 40 from the two sets of criteria. These are:

  • sponsorship
  • maintenance

People applying under the new Youth Mobility Scheme (currently the working holiday scheme) are required to score a pass mark of 50 from:

  • sponsorship
  • age
  • maintenance

The Home Office have provided transitional arrangements for those with existing leave to enter or remain under any of the old categories which will be closed when Tiers 2 and 5 are introduced.

Any applications for migration under the old system must be received by the Home Office by 26 November 2008.
