BRING AN EMPLOYEE TO CANADA

Canadian businesses can hire foreign workers from abroad through the many Temporary Work Permit Programs. These programs allow Canadian employers to bring an overseas candidate to work for them in Canada for a period between 3 months and 3 years at a time. This period is renewable.

In addition, these foreign workers may be eligible to be sponsored for permanent residence while working in Canada.

1. Permission to hire foreign workers

Employers wishing to bring staff from overseas need to seek approval to hire foreign employers. A business will be approved for a specified number of foreign workers for each available position. Prerequisites for permission to hire foreign workers may include advertising for the position to available Canadians.

2. Offer of employment

Employers need to provide an offer of employment for each position they wish to fill with a foreign worker. The position must relate to an occupation which meets the minimum requirements for skill level under the National Occupational Classification (NOC). The wages and working conditions for each position must match local working conditions and be sufficient to attract skilled workers in Canada. Licensing and accreditation requirements may apply for certain positions.

3. Visa Application

The person(s) identified to fill each vacancy must apply for a Visa to become employed in Canada. They will need to demonstrate that they have the required skills, experience and employment requirements which match those required for the position. In addition, they will be required to meet certain basic admissibility requirements.

In certain cases, employers can be eligible to have foreign workers come to work in Canada under expedited processing due to various programs or international agreements. Eligibility to proceed under any such programs is determined on case-by-case basis. If expedited processing rules apply, employers and candidates may be exempted from some of the above stages.
